Any sports fan who has ever gone to a game and been disappointed when a player they were expecting to see decided not to suit up, you now have a voice.
It is an idiotic, self-serving, pompous voice but a voice nonetheless.
Larry McGuinness, a Miami lawyer and Heat fan, has decided he is going to file a class action lawsuit against the San Antonio Spurs for resting their starters when they played the Heat in Miami back in November. The Spurs have already been scolded by the league and fined $250,000 but I guess McGuinness did not think that was enough.
Let us put aside for the moment the fact that the Heat only won by five, pulling away in the final moments of the fourth quarter to cap off a very exciting game. Let us also try to ignore the fact that this guy is clearly a rich Miami lawyer just trying to generate a little publicity for himself and enjoy his 15 minutes of fame.
No matter what the outcome of the game was or who it is suing an NBA team, no judge is going to want to set the precedent of having angry fans going to court every time they are not pleased with the product they bought a ticket for. If we are going to give refunds for starters not playing, why not blowouts as well? If one team wins by more than 20 points, I would say it was not a very good game and everyone should get their money back.
Oh please.
Even though McGuinness has now come out and said that every penny he makes off this lawsuit will be donated to Hurricane Sandy relief (what a standup guy, right?), I still cannot even hope a little bit that this ridiculous farce gains any traction. I thought the fine by the NBA in the first place was ridiculous. I cannott even come up with a word to describe how ludicrous this lawsuit is.
I will say though, I will not be surprised if a change in ticket selling policy comes out of this. NBA teams should start putting disclaimers with their tickets that say they do not guarantee the appearance of specific players, only the team on the schedule.
I really hope this whole thing goes away quickly. It makes me sad for humanity.
